Marc-André advises clients on insurance, professional liability and construction litigation. He handles coverage determinations in property and casualty and cyber insurance, defends insurers in complex class actions, and represents professional firms in contractual liability and errors and omissions cases.

He acts for insurers and insureds in the context of complex coverage disputes or in defending liability claims stemming from insurance losses. He has been actively involved in various class actions initiated against insurers in the wake of COVID-19.

Marc-André has argued before all levels of courts in Québec in the context of small or large claims. He has handled countless examinations and mediations over the years, working to achieve his client’s objectives.

With his solid background in construction law, Marc-André also acts for various clients in this sector, focusing on professional liability for engineers.

Marc-André taught insurance law at University of Montréal in 2022. He also heads the specialized insurance coverage subgroup in BLG’s Montréal office.

Marc-André is a sought-after speaker and provides continuous and frequent training to insurers and other insurance market players. He is also very active with industry organizations such as the CBA’s National Insurance Law section, the CBA-Québec’s Insurance Law and Civil Litigation section and the Association of Consulting Engineering Companies.

Experience

  • Represented insurers in class actions, notably in the following cases:
    • Centre de santé dentaire Gendron Delisle inc. v. La Personnelle, assurances générales inc., (2021 QCCA 1758);
    • Tessier v. Economical, compagnie mutuelle d’assurance (2023 QCCA 688);
    • Workman Optometry Professional Corporation v. Certas Home and Auto Insurance Company, (2024 ONCA 479);
    • Genereux et al. v. Intact Compagnie d’assurance (ongoing).
  • Provides counsel and compliance review in relation to Bill 96 impacts for insurers.
  • Acts for engineers in professional liability or fees disputes and provide general counsel and opinion to the industry on new regulations impacting engineering firms.
  • Represents developers, contractors, sub-contractors, suppliers of materials and insurers in construction-related disputes and losses.
  • Has particular experience in bodily injury claims, particularly those connecting with the safety of facilities, manufactured goods and/or buildings.
