Luke’s robust practice centres on civil litigation, focusing on a variety of related matters, including insurance and tort law and environmental law. Luke also frequently counsels clients on municipal and regulatory matters, including expropriation-related matters, municipal disputes, and hearings before regulatory tribunals.

In the area of insurance and tort law, he represents and advises insurance companies, professionals, manufacturers, commercial businesses, and individuals. In the area of environmental law, he represents and advises clients in a wide variety of contaminated site issues relating to both commercial and residential properties — including cost-recovery actions on behalf of plaintiffs and defendants.

He also provides legal advice and representation to companies on environmental regulatory compliance, emergency spill responses and environmental prosecutions.

Luke has appeared at all levels of B.C. courts on a wide range of matters, as well as before administrative bodies such as the Environmental Appeal Board, the Agricultural Land Commission, and the B.C. Utilities Commission. Throughout his career, Luke has focused on assisting clients in finding practical solutions to disputes and problems that arise in the course of their business.

Experience

  • Represented several appliance and equipment manufacturers and retailers on a number of product liability claims involving severe property damage.
  • More v. Bauer Nike Hockey Inc.: Co-counsel for Bauer Nike Hockey Inc. in a $14M negligent design and manufacture case. Obtained a full acquittal of all claims following a complex trial lasting three months. Also successfully represented Bauer Nike Hockey Inc. in More's appeal of the trial decision, which was dismissed.
  • Wright v. Sun Life Assurance Company of Canada: Co-counsel for Sun Life Assurance Company of Canada in a claim for long-term disability benefits, obtaining a full acquittal of all claims following trial.
  • Defended and successfully resolved a wide variety of motor vehicle accident claims at mediation and other forms of alternative dispute resolution. Also defended and argued a complex Uninsured Motorist Protection claim before an arbitrator, resulting in the dismissal of all claims.
  • Represented a major insurance firm in disability benefits litigation. Also represented various plaintiffs in personal injury claims, including a successful professional medical negligence claim. 
  • Defended a major airline on several significant personal injury claims under the Montréal Convention.
  • Defended an automobile manufacturer warranty provider in the successful dismissal of a warranty claim at trial.
  • Defending several manufacturers and facility owners in prosecutions under the Fisheries Act.
  • Negotiated environmental management and remediation cost agreements.
  • Commenced and defended cost recovery actions under the Environmental Management Act.
  • Represented and advised clients on environmental insurance issues, land development impacts, migrating pollution, and forestry issues.
